SCOPE

These general conditions of sale and use apply to all sales concluded through the website www.antregothique.com 

These General Conditions of Sale can be consulted and accessible at any time on the site, and will prevail over any other version or contradictory document. They may be subject to subsequent modifications, the version applicable to the purchase being that published on the site at the time of actual validation of the order by the customer. 

Any modification of the General Conditions of Sale is binding on customers upon publication on the site, and cannot apply to transactions previously concluded. In any case, the customer is invited to carefully read the General Conditions of Sale and Use.

You acknowledge having read, before your order, these General Conditions of Sale and having received all the information listed in article L.221-5 of the Consumer Code in a readable and understandable manner. Validation of your order constitutes unreserved acceptance of these General Conditions of Sale.

Article 1: CONDITIONS OF SALE

1. Identification and customer account 

To use AntreGothique® Services, you represent that you are at least the age of majority in your country, state or province of residence, or that you have given us your consent to allow anyone under the age of majority to your responsibility to use AntreGothique®.

The customer has the possibility of registering on the site at the time of purchase or beforehand, and of creating his customer account by indicating his email address, which will serve as his identifier. He is then asked to indicate his first name, his last name, his password, his postal address, his telephone number. 

Creating an account is not obligatory. The customer can act as a “guest” while providing the necessary information (name, postal address, email) to process their order.

The customer undertakes to maintain the confidentiality of his username and password and is prohibited from disclosing it to any person. The customer is solely responsible for the use of his codes and access to AntreGothique®.

2. Order

By placing an order, you declare that you are acting exclusively in a private capacity.

The ordering process is as follows:

• Choice of products and addition to basket
• Validation of basket contents
• Transmission of information necessary for the proper processing of the order or identification on the site via the customer account
• Choice of delivery method
• Choice of payment method and acceptance of these General Conditions of Sale
• Payment validation

The customer will be able to view the details of their order and its total price and correct any errors, before confirming this to express their acceptance by clicking on “Pay now” to validate the payment. 

After confirmation of their order, the customer will receive an order confirmation email within one working day. 

Any order constitutes acceptance of the prices and description of the products.

3. Order validation

The “Pay now” button allows you to confirm your order which then becomes final, and a sales contract is concluded. Automatic recording systems are considered as proof of the nature and content of the order. AntreGothique® confirms acceptance of the order to the customer at the e-mail address provided by the customer. The sale will be concluded from the validation by AntreGothique® of payment for the order, that is to say from the date of validation of payment for orders paid online by credit card. 

AntreGothique® reserves the right in any case to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. In the event that an order is not accepted (in particular due to the unavailability of one or more product(s), AntreGothique® will inform the customer by any means.

4. Cancellation before order processing

If you change your mind before your order is processed, we accept cancellation.

Article 2: PRODUCTS FOR SALE

The essential characteristics and the price of our products are indicated on the pages containing the detailed description of the products in the online store.

1. Price

Prices are indicated in euros including tax, excluding shipping costs.
The price includes the price of the products, the costs of handling, packaging and conservation of the products. Prices are subject to change at any time without notice, knowing that the items will be invoiced at the price in effect when the order is placed.

All orders are invoiced in euros and payable in euros.

Any customs fees or local taxes remain the responsibility of the recipient.

2. Availability of items

As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of consultation of the site by the customer remains dependent on the state of stock at AntreGothique®.

Only the permanent shortage of an item from our suppliers results in its deletion from our sales offer. In other cases, a new order within a certain period remains possible.

3. Unavailability of items

When there is unavailability of an ordered item, the customer is informed by email or on the invoice of the items shipped in the case of an order for several items.

We draw your attention to the fact that we are exempt from delivering the ordered goods if the goods are unavailable.

The order will be canceled in whole or in part and we will refund the amounts you have already paid for undeliverable items.

4. Pre-orders

Articles to be published are available on the site www.antregothique.com.

A pre-order is the opening of the reservation phase of an article made with the indication of the release date of this article announced by the publisher. This announced release date may be changed at any time by the publisher who is solely responsible for the marketing of its product. In all cases, AntreGothique® endeavors, from the final sale date, to ship articles to customers who have reserved them, up to the stock provided by the publisher.

5. Shipping costs

Shipping costs include a contribution to preparation, packaging and postage costs. Consider grouping all your items into one order. We will not be able to combine two separate orders and you will be charged shipping costs for each of them.

The prices of the products displayed on www.antregothique.com exclude delivery costs. Depending on the amount of your order or the delivery method you have selected, you will be charged delivery costs.

Payment for shipping costs will be collected at the time of purchase in the final amount of your order.

It is important to note the difference between shipping and delivery. Indeed, shipping corresponds to the action of sending the items from an order, delivery corresponds to the act of transporting items and ensuring their delivery to a destination address.

Article 3: PAYMENT

- By bank card (Visa card, Eurocard/Mastercard) in the payment form offered during the order process (entry secured by SSL encryption), by entering the type of card, the number of your card without spaces between the numbers, the control number (located on the back of your card) as well as the expiry date.

- By PayPal Payment: you have different payment methods and you can even benefit from payment facilities by credit card.

Payment is made on the secure banking servers of our partners. This implies that no banking information concerning you passes through the site www.antregothique.com.

Payment by credit card is perfectly secure. Your order will be recorded and validated upon acceptance of payment by the bank.

The information relating to your order is subject to automated data processing for which our banking partner is responsible. The purpose of this automated data processing is to define a level of analysis of a transaction and to fight against bank card fraud. The occurrence of an unpaid amount due to fraudulent use of a bank card will result in the details relating to your order associated with this unpaid amount being entered in a payment incident file.

An irregular declaration or an anomaly may also be subject to specific treatment. AntreGothique® reserves the right to verify the personal data communicated by the customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent payments. 

This verification may take the form of a request for proof of identity and/or address. The lack of response from the customer to a request of this type within two days following the request made by AntreGothique® will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint. AntreGothique® will also be free to proceed with the direct cancellation of an order which presents one or more risk factors for fraudulent use of a bank card.

Article 4: DELIVERY CONDITIONS AND TIMES

Orders shipped internationally may be in transit for 4 days. However, this period may exceptionally be longer (up to twenty days) depending on the type of delivery selected, the supplier, the carrier linked to the items in the order.

We deliver to your home or to a relay point. The delivery time includes the preparation time of the package plus the delivery time. AntreGothique® delivers worldwide.

The customer is notified by email of the shipment of his order. This email contains a link allowing you to know the different stages of the delivery of the order by the carrier.

When you place an order with AntreGothique®, the maximum shipping time is 5 business days. Delivery can range from 2 to 4 weeks.

The delivery time does not bind AntreGothique® in any way in the event of a longer delay.

Article 5: WITHDRAWAL, RETURNS AND REFUND

The items supplied by AntreGothique® are new and guaranteed against any defects. They are identical to those of traditional commerce and come from all the publishers and suppliers listed.

1. Right of withdrawal

In accordance with the provisions of articles L.221-18 et seq. of the Consumer Code, the customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or withdrawal of the item(s). ) to exercise your legal right of withdrawal without giving any reason and thus notify AntreGothique® of your intention to return the item(s).

If the items may be subject to the legal right of withdrawal, the customer exercising his right of withdrawal (under the conditions provided for in this article in terms of time limit and terms of return of the items), will be able to obtain a refund of the returned items.

When the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended until the first following working day.

2. Exercise of right of withdrawal and return terms

You must send us your clear declaration of withdrawal in electronic form, via our website. We will send you an acknowledgment of receipt of your declaration by email.

To respect the withdrawal deadline:

• You must send us your declaration of withdrawal before the expiry of the period of 14 calendar days,
• Items must not have been used, opened or damaged,
• Items must be returned undamaged and unused in their original packaging. If applicable, the packaging must retain the original seal.

The implementation of the right of withdrawal has the consequence of obliging the customer to return or return the items without delay, and at the latest within 14 calendar days from the exercise of his right.

In accordance with article L.221-23 of the Consumer Code, return costs are the responsibility of the customer.

No cash on delivery will be accepted, whatever the reason.

3. Verification of returned items

Upon receipt of the package returned by the customer, AntreGothique® will inspect its contents and check the condition of the returned items. It is only after this inspection that the reimbursement will be made (or not) by AntreGothique®.

In the event of refusal of reimbursement, we will inform you by email (supporting photo if necessary) of the reasons for our refusal of reimbursement.

4. Exception to the application of the right of withdrawal

In accordance with article L. 221-28 paragraph 5 of the Consumer Code, the legal right of withdrawal is excluded in the case of sealed items which have been opened after delivery or which cannot be returned for health reasons or hygiene.

5. Reimbursement

In the event of exercising the right of withdrawal, AntreGothique® is required to reimburse the sums paid by the customer, free of charge, with the exception of return costs. The refund is due within a maximum of 14 working days from the date of receipt of the returned package(s).

The refund will be made by the AntreGothique® Payment Service Provider after confirmation by AntreGothique® of the return of the item(s) ordered, by the same payment method as that used by the customer for the initial transaction. 

No cash on delivery will be accepted, whatever the reason.

Article 6: LEGAL GUARANTEES

1. Legal guarantee of conformity

The items sold through AntreGothique® comply with the regulations in force in France and have performances compatible with non-professional uses. Sales made on the site www.antregothique.com are subject to the conditions of the legal guarantee of conformity provided for in articles L.217-4 et seq. of the consumer code as well as the legal guarantee against hidden defects set out in articles 1641 et seq. of the Civil Code. 

They benefit automatically and without additional payment, independently of the right of withdrawal and in accordance with legal provisions:

• the legal guarantee of conformity, for products that are apparently defective, damaged or damaged or do not correspond to the order,
• of the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use.

The conditions of this guarantee are referred to in the article “Amicable settlement and mediation” of these General Conditions of Sale.

2. Non-compliance and return conditions

In the event of a defective or non-compliant item, the customer has 15 calendar days from receipt of the items to request an exchange. If the fifteen (15) day period normally expires on a Saturday, Sunday or public holiday, it is extended until the first following working day. 

The customer must first send proof of the defect(s) observed to contact@antregothique.com (description and photos attached).

The customer must return new or unused items in their entirety and in their original packaging, intact, accompanied by all possible accessories, instructions for use and documentation (in the original cellophane packaging and with the invoice). corresponding).

Return shipping costs to the address we indicate are the responsibility of the customer.

3. Transfer of ownership 

The transfer of ownership of the items to the benefit of the customer will only be carried out after full payment of the price by the latter, regardless of the delivery date of said items. However, the transfer of risks of loss and deterioration of the items will take place upon delivery and receipt of said items by the customer.

The descriptions of the products present in the AntreGothique® databases were entered according to the information communicated by the publishers. AntreGothique® is not responsible for the content of the works and cannot be held liable towards the client.

AntreGothique® declines all responsibility if the delivered item does not comply with the legislation of the country of delivery (censorship, ban on a title or author, etc.). AntreGothique® is not responsible for the content of sites to which hypertext links may refer from its own site.

Article 7: DATA PROTECTION

1. Data ownership and processing

AntreGothique® is the producer and owner of all or part of the databases making up its site. By accessing the site, the customer acknowledges that the data concerning him or her is legally protected, and is prohibited in particular from extracting, reusing, storing, reproducing, representing or preserving, directly or indirectly, on any type of support, by any means and in any form whatsoever, all or part qualitatively or quantitatively substantial, of the content of the databases of the site to which it accesses.

The customer undertakes, by accessing the AntreGothique® site, not to save or transmit files that contain viruses or any other contaminating or destructive function, not to use false information or third party information, not to not harm the image of AntreGothique® in particular in the context of the assessments it makes on the site or on third-party sites, and more broadly not to make any use of AntreGothique® which could give rise to any civil or criminal prosecution according to the laws in force.

The customer undertakes to indemnify and guarantee AntreGothique® on first request for any damage, loss or loss of profit that it may suffer.

2. Personal data

In application of law 78-17 of January 6, 1978 amended by law n°2018-493 of June 20, 2018, it is recalled that the personal data requested from the customer by AntreGothique® are necessary, both to guarantee access to the services of AntreGothique®, only for the processing of its orders. AntreGothique® undertakes to ensure the security of the personal data it retains for the purposes of fulfilling and tracking orders. The processing of information communicated to AntreGothique® meets legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.

The customer has, in accordance with national and European regulations in force, a right of permanent access, deletion, modification, the right to portability and limitation of processing with regard to information concerning him subject to the legal obligations of 'AntreGothic®.

As part of an order made by the customer on AntreGothique®, the customer's personal data will be processed by AntreGothique®.

Your data is processed in the European Union, with some exceptions. In the event that AntreGothique® uses a service provider located outside the European Union, rules guaranteeing the protection and security of your information will be put in place by AntreGothique®. The customer has the right at any time to decide and control the use made of his data and to request it:

AntreGothique® will have one month from receipt of requests to respond.

In the event of difficulty relating to the management of their personal data, the customer has the possibility of contacting the National Commission for Information Technology and Liberties (CNIL). Finally, the customer, noting that a violation of the General Regulations on the Protection of Personal Data has been committed, has the possibility of mandating an association or an organization mentioned in IV of article 43 ter of the Data Protection Act of 1978 , in order to obtain compensation against the data controller or subcontractor before a civil or administrative court or before the National Commission for Information Technology and Liberties.

Article 8: Force majeure

AntreGothique® cannot be held liable for any inconveniences or damages inherent in the use of the Internet network, in particular an interruption or rupture of the service, an external intrusion or the presence of computer viruses, or in cases of force majeure. as defined by French case law. 

Article 9: AMICABLE SETTLEMENT AND MEDIATION

The applicable law is French law.

Under article L. 612-1 of the Consumer Code “Every consumer has the right to have free recourse to a consumer mediator with a view to amicably resolving the dispute between him and a professional. ". This covers disputes of a contractual nature, relating to the execution of a contract of sale or supply of services, between a consumer and a professional.

Article 10: Autonomy of clauses

If one or more stipulations herein are held to be invalid or declared as such in application of a law, regulation or final decision of a competent court, the other stipulations will retain all their force and scope. .
